A comment on 'Does the Freeze-Deal Make Sense?' by Yoram Ettinger
Recently Yoram Ettinger wrote an article entitled: 'Does the Freeze-Deal Make Sense?', which really made me sit up and take notice because today there is a quite a big fuss about Israel needing to freeze settlements before the Palestinians will return to the peace table. In Mr. Ettinger's article he looks at many related issues, but concerning the actual settlements, he asks some really straight questions, the answers to which I think, will not be forthcoming from this lips of those who in my opinion, 'lie' to betray their Anti-Semitism.
In the First of 5 sections in the article, he writes:
The complex nature of Jewish construction in the Settlements. If Jewish construction in Judea and Samaria prejudges the outcome ofnegotiation, wouldn't Palestinian construction in Judea and Samaria have the same effect?!

If the 300,000 Jews, among 1.5MN Arabs, in Judea and Samaria constitute an obstacle to peace, how would one define the 1.5MN Arabs,among 6MN Jews, within pre-1967 Israel?!
If Jewish settlements/communities in Judea and Samaria (est. 1967) constitute the obstacle to peace, why was the PLO established in 1964?! Why did anti-Jewish Palestinian terrorism flare up during the 1920s, 1930s and 1940s?! Why did the Arab-Israel wars erupt in 1948/9,1956 and 1967? Why did an unprecedented Palestinian terrorism surge following the 1993 Oslo Accord and the 2005 uprooting of 25 Jewish communities in Gaza and Northern Samaria?!
Past freezes, slowdowns and dismantling of Jewish construction in Judea and Samaria intensified pressure and exacerbated terrorism what would be the impact of another - freeze?!
All of the above notwithstanding, Mr. Ettinger then goes on to look at the relationship between Israel and the United States of America, noting that it is not perhaps a good idea for Israel to put it's faith in American Presidents. Given what he details in Section 2 of the article, I would wonder why it is that anyone in Israel would want to put their trust in a US President. As Mr. Ettinger points out:
1954: US-Taiwan defense treaty was concluded by President Eisenhower. 1979: Terminated by President Carter
1957: Eisenhower commits to military deployment if Egypt violates Sinai's demilitarization. 1967: Johnson declared the commitment 'non-binding'.
1975: Ford supports the Golan Heights remaining under Israel's control. 1979: Carter declared Ford's letter non-committal.
1982: Reagan stipulated that F-15s sold to Saudi Arabia not be south of Eilat. 2003: Bush justified the Saudi deployment of same
1991: Bush made a deal with Prime Minister Shamir. Shamir kept his word, Bush did not.
2000: Clinton offers Israel $800MN to retreat from Southern Lebanon. Still awaiting the Money!
The article is written by someone who has reason to look closely at all the questions and answers concerning Israel and the Middle East. The questions posited merit answering, not with hyperbole and emotional accusations against Israel, but with reasoned logic.
I wonder if anyone will give him such a reasoned reply?

With The Legal Foundation and Borders of Israel under International Law (Mazo Publishers, Jerusalem) Canadian-born Israeli constitutional scholar and lawyer Howard Grief has given us a book that shatters every myth, lie, misrepresentation and distortion employed over the 61 years of Israel's existence to negate the sovereign rights of the Jewish People to their national home.
The Legal Foundation lays bare two dominant myths that have shaped popular perspectives on Israel. The first is the fallacy that Jewish sovereignty over the land of Israel was the joint product of the 1947 United Nations Partition and the May 15th, 1948 termination of the British Mandate for Palestine. In fact, as Grief points out, Jewish sovereignty in Palestine had been validated under international law 28 years earlier. "The legal title of the Jewish People to the mandated territory of Palestine in all of its historical parts," he informs us, was first recognized on April 24, 1920 when the post-World War I Allied Supreme Council (Britain, France, Italy and Japan), meeting in San Remo, Italy, "converted the 1917 'Balfour Declaration' into a binding legal document."
a second major misrepresentation of Israel's international legal status - the erroneous assumption that the Partition Plan and the May 1948 termination of the British Mandate somehow erased the Jewish People's rights to Palestine in all its historical parts and dimensions enunciated at San Remo, and implemented under the terms of the League of Nations Covenant.
The presumptive cancellation of those rights, Grief submits, is thoroughly discredited by "the principle of acquired rights," codified in the 1969 Vienna Convention on the "Law of Treaties," and the "doctrine of estoppel."

Taken by itself, the fact that the Oslo accords do not constitute authentic treaties under the Vienna Convention - because they link a state with a nonstate party - does not call for abrogation. But as the nonstate party in this case just happens to be a terrorist organization whose leaders must be punished for their egregious crimes, any agreement with this party that offers rewards rather than punishments is entirely null and void. Significantly, in view of the peremptory expectation known in law as Nullum crimen sine poena, "No crime without a punishment," the state party in such an agreement - here the State of Israel - violates international law by honoring the agreement.
According to Principle I of the binding Nuremberg Principles: "Any person who commits an act which constitutes a crime under international law is responsible therefore and liable to punishment." It is from this principle, which applies with particular relevance to Hostes humani generis ("Common enemies of humankind") and which originates in three separate passages of the Jewish Torah, that each state's obligation to seek out and prosecute terrorists derives. Hence, for Israel to honor agreements with terrorists - agreements that require, among other pertinent violations - the release of thousands of other terrorists - is to dishonor the very meaning of international law.
Prime Minister Netanyahu, please take heed. International law does not require compliance with the Oslo Accords. It requires abrogation of these illegal agreements.

IN THESE PSYCHO-POLITICAL circumstances it would be very gutsy to aim to win instead of insecurely trying to conciliate an in-your-face uncooperative "peace partner."
We blabber about "occupation" without asking by which line Arabs demarcate areas where a sovereign Jewish existence might possibly be accepted. Is it the 1949 line? 1947? None at all? Does "occupation" refer only to territories we have held since 1967 or also where Jews settled in 1870?
Judge Richard Goldstone has presented his report on Gaza and, among other recommendations, suggested that Israel conduct its own inquiry. Israeli government officials, assuming he meant an investigation like his into Israel's misdeeds, declined, noting that that they have and continue to investigate their army's behavior on a constant basis.
But after reading most of the report, another possibility presents itself. It rapidly becomes clear to any reader not driven by a thirst for "dirt" on Israel, that Goldstone's work represents a new low in the tragically deteriorating world of international justice. It fails on every count, from its handling of evidence, to its legal reasoning, to its unstated but pervasive assumptions of Israeli guilt and Palestinian innocence, to its astonishing conclusion (from someone who knows the gruesome details of Bosnia and Rwanda), that Israeli behavior was so bad it might well constitute "crimes against humanity."
As a result this report takes the army with the best record in the history of warfare for protecting enemy civilians and accuses it of targeting them. Goldstone makes Kafka's Trial seem fair.
what could one expect from a committee created by the ineptly titled UN Human Rights Council, which is dominated by rogue regimes like Iran, Syria, Somalia, Libya, Cuba and Liberia? Some of the leaders of the member-states would qualify as candidates for prosecution as war criminals. The council's principal common denominator remains an obsessive hatred of Israel, which they condemn more frequently than all the other 191 member-states combined.
In fact, since its inception in 2006, 26 of the 32 resolutions condemning human rights violations passed by the council were directed against Israel. It should also be noted that this UN "human rights" body declined to investigate the monstrous brutalities inflicted on civilian populations in Chechnya, Sri Lanka and Sudan. Indeed it went so far as to bizarrely thank the Sudanese government, the perpetrators of the Darfur massacres, for its "cooperation."
If Zbigniew Brzezinski had his way, the US would go to war against Israel to defend Iran's nuclear installations.
Brzezinski has long distinguished himself as one of the most outspoken Israel-haters in polite circles in Washington. Under normal circumstances, his remarks could be laughed off as the ravings of a garden variety anti-Semite. But these are not normal circumstances. Brzezinski served as a senior foreign policy adviser to Barack Obama during his 2008 presidential campaign, and his views are not terribly out of place among Obama's senior advisers in the White House.
In an interview in 2002, Samantha Powers, who serves as a senior member of Obama's national security council, effectively called for the US to invade Israel in support of the Palestinians.
The fact of the matter is that Brzezinski's view is in line with the general disposition of Obama's foreign policy. Since entering office, Obama has struck a hard-line position against Israel while adopting a soft, even apologetic line toward Iran and its allies.
The UNHRC's resolution effectively delegitimized Israel's right to exist by denying that it has a right to defend its territory and its people from illegal aggression carried out by an illegal terrorist organization.
Mohamed ElBaradei, the UN's International Atomic Energy Agency's virulently anti-Israel chairman, announced a deal has been reached between Iran and the US, Russia and France regarding Iran's nuclear program.
But now that the administration has agreed to an accord that effectively transforms America into a facilitator of Iran's nuclear weapons program, the time has come for Israel to start voicing its objections.
The most violent exploitation of fabricated claims of Jewish aggression against Judaism's most sacred site to date, of course, came in September 2000. In keeping with this policy, President Barack Obama paid a preening visit to Ankara where he effectively endorsed the Islamization of Turkish foreign policy that has moved the NATO member into the arms of Teheran's mullahs. Taken together, the actions of the Bush and Obama White Houses have demoralized Westernized Turks, who now believe that their country is doomed to descend into the depths of Islamist extremism. As many see it, if they wish to remain in Turkey, their only recourse is to join the Islamist camp and add their voices to the rising chorus of anti-Americanism and anti-Semitism sweeping the country.
As the politically activated humanitarians constantly scrutinize everything done in Palestine by Israel, and jump up and down about what rotten sods the Israelis really are, they seem not to be aware of what the Palestinians themselves are saying about the state of affairs in Gaza.
"We are telling the world that we don't deserve a state because we are murdering each other and destroying our universities, colleges, mosques and hospitals. Today I'm ashamed to say that I'm a Palestinian."
In our demented western multicultural sycophantic madness, are we really unable to understand that for many in the Muslim world, violence is a way of life. How is it that we can jump up and down over a few rashly spoken racist comments, but say nothing when we hear and see the worst aspects of 'ethnic culture'. Why is it do you think, that we care so little for victims of crime while our hearts bleed for the criminals? Why is it that the things we despise in our own culture, are acceptable when found in other cultures?
Colonel Richard Kemp (the former commander of British forces in Afghanistan), who said, "From my knowledge of the IDF and from the extent to which I have been following the current operation, I do not think there has ever been a time in the history of warfare when an army has made more efforts to reduce civil casualties and deaths of innocent people than the IDF is doing today in Gaza."

Arabs who left homes and property in Israel and many from other countries who joined Arab armies and did not want to return, remained in Lebanon, Syria, Jordan, most as "refugees" under the care of UNRWA.
This heterogeneous population was called "Arab refugees," not "Palestinians," because at the time there was no such group, or people.
called "Arab refugees" was because there were many other refugees in Palestine,.. Hundreds of thousands of Jewish refugees from Arab countries streamed into Israel. UNRWA offered no aid...
The designation "Palestinian" did not become widely accepted until after the war in 1967...
As the PLO launched mega-terrorist attacks around the world, "Palestinianism" became accepted, backed by the Arab League, Muslim and "non-aligned" countries, and the United Nations.
As the proportion of anti-Israel countries in the UN grew, "Palestinians" were given more and more recognition, support and legitimacy, unlike any other group.
And the fraud worked! It worked so well because the world's media accepted the Palestinians' self-definition and their cause.

I was standing in that holiest of places, which generations of Jews for 2,000 years could only dream of visiting, I was forbidden to pray. Simply moving my lips in whispered prayer could be grounds for removal. Why? Because I am a Jew. And only a Muslim can pray on the holiest site in Judaism. A Jew may not.
DURING THE War of Independence in 1948, the Old City of Jerusalem fell to the Jordanians. Nearly 1,500 Jews, including many women and children, were killed.
In June 1967, when Egypt, Syria and Jordan embarked on a war to annihilate the Jewish state, Israel recaptured Jerusalem's Old City.
But then, in a mind-boggling display of attempted appeasement of an enemy that just days before had sought Israel's destruction, defense minister Moshe Dayan decided to allow the Muslim religious council, the Wakf, to retain administrative authority over the Temple Mount. Thus, a truly bizarre and unacceptable situation developed.
I think it is time for us to realise that there is something going on in the United Nations that is working within an agenda far removed from Democratic Principles and Personal Freedoms that we expect.
Academics have for a long time been Shifting Previous Historical Perspectives, trying to establish themselves in one way or another. Re: Fort Hood Massacre I invite readers to think about the educators of our "politically correct" or non-judgmental media, because the core of the problem consists not in cowardly or obfuscating journalists but rather the universities that educated them.
We boast of these universities, even though they produce so many moral idiots. I mean men and women stultified by the academic doctrine of moral or cultural relativism. Because it is this doctrine that prompts "politically correct" fools to hire Muslims to serve on US military bases.

In defiance of demographic fatalism, Israel's demographic momentum has been Jewish.Since 1882 (the launching of annual Aliya), the Jewish population between the Jordan River and the Mediterranean has grown 238 fold, while the Arab population increased only 6 fold.Since 1948, the Jewish population increased almost 10 fold and the Arab population expanded 3 fold.
In sharp contrast to conventional wisdom, the UN Population Division reports a sharp decline of fertility rate (number of births per woman) in Muslim and Arab countries, except in Afghanistan and Yemen.The myth of "doubling Muslim population every 20 years" has been shattered against the rocks of modernity and reality.
"In 1920, Great Britain was given the responsibility by the League of Nations to oversee the Mandate over the geographical territory known as Palestine with the express intention of reconstituting within its territory a Jewish National Home. The territory in question stretched from the Mediterranean Sea to the eastern boundary of Mandatory Palestine, which was a border that would separate it from what was to become the future state of Iraq.
In 1921, however, Churchill unilaterally gave away most of this territory to the Hashemite dynasty to create what later became known as Jordan.
That expression 'except unto themselves' is the key to understanding Political Correctness in all it's forms. The purpose of "Politically Motivated Political Correctness Activists" is to make you dependent upon them for 'moral guidance' until you reach the point wherein their power supercedes all other. In short: 'They have an agenda not directly connected to their alleged 'ideology'. We must begin to realise that every source of information has it's own agenda, and that the information provided is designed to stir up our support for that cause. It never ceases to amaze me that those who have a "Just Cause" to fight, have no hesitation resorting to 'Unjust' - 'Dishonest' behaviour. There can never be any excuse for such, but our willingness to ignore the truth is often the result of our own prejudice - 'prejudice whipped up for us by someone's Media propaganda Unit.'
Notice that "Amnesty's claims were later shown to be unsubstantiated'. The article states that despite the fact that on the 'face of it', amnesty was sharing the blame between Israel and Hamas, the fact is that they concentrate their accusations on Israel whilst ignoring amongst other things, that Hamas is a terrorist organization.
The Jenin Massacre is just one instance where the call for Israel's blood, with accusations of war crimes, was made, because so many humanitarian do gooders prefer Terrorists to Jews.
They don't want freedom of the press - they want control. They don't want money for the suffering masses - they want money for guns. They don't want Arab nations mediating peace agreements with Israel - they want Israeli blood.
They have a taste for power and a love of ideology - just like Amnesty International - and no one and nothing will be allowed to interfere with that. To surrender their power and ideology would destroy them. It would make of them 'ordinary citizens' in 9-5 jobs. B-O-R-I-N-G!
It is only if the true history of the Middle East is understood that certain things become inescapably clear: the scale of the monumental lie that has been so assiduously promulgated about the nature of this dispute, a lie which is now generally assumed in the west to be true and which is driving the genocidal hysteria against Israel; the fact that the fundamental cause of this tragic impasse was the repeated British appeasement of Arab terror, illegality and injustice, a policy which continues to this very day; and the immorality and absurdity therefore of believing that today's ‘two-state solution’ which among other things means that the ‘progressives’ who support it thus support the ethnic cleansing of all Jews from the putative state of Palestine would be anything other than a Final Solution for the Jews of Israel, not to mention an incalculable victory for the forces waging war against the free world.
Of the countless distortions, errors and absurdities in this travesty of a report, the following jumped out at me from an initial reading.
1) The first error is in the title itself: HUMAN RIGHTS IN PALESTINE AND OTHER OCCUPIED ARAB TERRITORIES: Report of the United Nations Fact Finding Mission on the Gaza Conflict
But Gaza is not occupied by Israel, as is quite clear from even a cursory look at the Hague Convention which lays down the criteria for occupation. For Goldstone to say that Gaza is still occupied demonstrates either an ignorance of international law quite remarkable for a professor of international law, or that he is signed up to the ideology which deliberately uses such mis-statements to delegitimise Israel.
2) Par 27: Goldstone describes Gaza as blockaded by Israel. He makes no mention of Gaza’s border with Egypt which Egypt keeps closed. Is Goldstone as ignorant of topography as he appears to be of international law? Unlikely, since he also states [par 8] that
the Mission sought and obtained the assistance of the Government of Egypt to enable it to enter the Gaza Strip through the Rafah crossing.
There are clear attempts being made to spark a third intifada in Jerusalem. Violence by Israeli Arabs started two weeks ago in the wake of the meeting between Israeli Prime Minister Netanyahu, President Obama and the Palestinian Authority President Mahmoud Abbas, and Obama's inflammatory call at the UN for a Palestinian state that ends the occupation that began in 1967.
"The riots are being directly incited by the PA, whose official media outlets and institutions are stoking Arab flames by claiming right-wing extremist Jews are attempting to threaten Al-Aksa Mosque - a decades-old blood libel that should be easily dismissible in light of heavy Israeli restrictions on Jews and Christians from ascending the Mount during most hours of the day, whereas Muslims are usually free to access the site 24/7.
Israeli law prohibits Jews and Christians from praying on the site. If any so-called extremist Jew attempted to enter Al-Aksa, he or she would likely be immediately removed from the Temple Mount by Israeli police, who follow Jewish tour groups very closely and coordinate with the Wakf, the Islamic custodians of the site.
Fred Fleitz, a former senior adviser to Bolton, exposes UN waste and corruption and the resulting human costs. His book, Peacekeeping Fiascoes of the 1990s: Causes, Solutions, and U.S. Interests, provides a comprehensive critical assessment of the UN. Among other debacles, he shows how the failed UN mission in Bosnia led to unmitigated atrocities; how the UN debacle in Somalia emboldened terrorists the world over; how the UN peacekeeping operation in Haiti collapsed, with the billions of dollars squandered on it primarily benefiting Haitian President Jean-Bertrande Aristide. And then there was the "oil for food" scam between the UN and Saddam Hussein.
In spite of all the brutality which again and again has been used against the Jews, and only against the Jews, it has not caused most of the Jews to realise its true cause.

The massacres on the established Jewish society as in Hebron, Jerusalem and Safed, and the murder of Arab-speaking Jews and Jewesses, who had Arabs as neighbors and business partners, shocked the established Jewish community so deeply that none of them dared to come back home to Hebron after the liberation in 1967, despite the fact that their families had lived their from time immemorial.

The baker Noach Immerman was grilled alive over an open fire. . The rabbi of Zichron Ya’akov, Avraham Ya’akov Orlansky Hacohen, who came to pray in Hebron, was taken away in the middle of prayer still wearing his prayer shawl. His brain was cut out and his wife murdered by hacking her bowels to small pieces. [the doctor and] pharmacist Gershon Ben Zion, who was dependent on the wheel-chair, who had worked in Hebron for more than 40 years and who had extensively helped the Arab population, got his nose and fingers cut off before he was murdered. His daughters were raped and murdered under cruel torture. Both of his wife’s hands were hacked off and she died in the hospital in Jerusalem. The 2 year old Menahem Segal was beheaded. The teachers Haim-Eliezer Dobnikov and Yitzhak Abushadid were murdered by hanging... Rabbi Grodzensky’s eyes were cut out before his head was smashed. A girl was raped by 13 Arabs, right in front of her father, before he too was murdered. Her mother and sister were seriously mutilated. In the house of Abushadid’s family, a baby was held by the legs and struck against the wall smashing his head. Many people had their eyes cut out before they were murdered.
What other country in history has ever been required to provide all the basic necessities to enable their enemy to attack and murder them? Until Israel wakes up to the fact that no one really cares about Israel or Jews; until Israel wakes up that Political Correctness is just a tool by which people can hide their true feelings whilst showing a compassionate face, then Israel is doing nothing more than committing slow suicide. No one cares! No one wants Israel there! They all want to lick the boots of Activist Agendas and Arab Oil and they believe that Israel is worth sacrificing if it means peace from terrorism (but it won't).
It was decided that unshod horses would not be allowed to be used in commercial ventures. People couldn't ride horses for a living; salesman couldn't load goods onto their horses; and horses could no longer pull carts. The original command to anoint Jehu as king over Israel (not Judah) was given to Elijah the prophet in 1 Kings 19:15-17 in which he is commanded to anoint Hazael as King over Syria (in place of BenHadad) and Jehu over Israel in place of Ahab's son Jehoram. And there is a promise from God that those who escape from Hazael will be slain by Jehu and those who escape Jehu will be slain by Elisha. But even though the Scripture talks about killing the King of Israel's heirs (the house of Ahab), no where does it say that anyone is to kill the King of Judah "Ahaziah", who was either Ahab's grandson, nephew or son-in-law. (2 Kings 8:18 makes his mother to be the daughter of Omri and therefore sister of Ahab and so he was Ahab's nephew, while verse 26 states that his mother was Ahab's daughter therefore he was Ahab's grandson but verse 27 refers to him as son-in-law).
Myths, Fables, Legends: But with the passing of the ages, the elders and leaders of the dragon clan grew old and weak, until one day they discovered that the lands within the boundaries of the four winds had been invaded by a strange 'new' race of beasts, and many feared that they meant to overthrow the Elders of the Dragon Clan and claim the kingdom for themselves. The Premise: Between the 5th and 3rd centuries BCE (but continuing down to at least 104 BCE), Sectarian redactors transcribed the legitimate 'solar year' chronological records of Israel and Judah, into an artificial form, with listed years as each comprised of 12 months of 4 weeks of 7 days, or 336 days per year, thus creating a 13th artificial year where 12 solar years existed.
When the Synchronous Chronological Data provided in the Books of Kings and Chronicles for the Divided Kingdom Period are measured in years of 336 days, the synchronisms actually align. [Refer to Appendix 5. to see how it synchronises the Divided Kingdom Period]
